Terms and Conditions
1. Who these terms are with
These terms cover every mobile application published by Sparks Financial Ventures Ltd, company number 513955922, Bror Hayil, Southern District, 7915200, Israel (“we”, “us”), and this website. Not every app does everything described here, and a clause about something an app does not offer simply does not apply to it.
By installing an app, creating an account, or continuing to use it, you agree to these terms and to our Privacy Policy. If you do not agree, do not use them.
2. Age
Our games are not intended for anyone under 13. Lia — Your Styling Assistant is not intended for anyone under 18. Do not create an account if you are below the age for that app.
3. Your account
Where an app has accounts, it creates one for you the first time it needs our server, and it becomes permanent when you sign in with Apple, Google or an emailed code. Keep control of the address and provider account you sign in with — anyone who has them has your account.
You can delete your account at any time from inside the app; in Lia that is Profile → Delete Account. Deletion is immediate and permanent: credits, imports and everything stored on the device go, and none of it can be recovered. You can also ask us to delete it — see the Privacy Policy.
4. What you upload
Your photographs stay yours. Where an app works on images you choose, you give us only what we need to run the feature: permission to store, transmit and process each image you add, and to have our processing provider do the same, for as long as it takes to produce your result and no longer. We do not use your photographs to train models, and we do not publish them.
By uploading an image you confirm that:
you own it or have the right to use it;
if it shows another identifiable person, you have their permission;
it is not unlawful, and does not infringe anyone's rights.
We may remove content and suspend accounts that break this clause.
5. Automatically generated results
Some of our apps use automated image processing to produce a picture from a photograph you supplied — for example finding the clothes in a picture and drawing each garment on its own. The result is a generated approximation, not a photograph of a real product. Colours, shapes and details can be wrong, things can be missed, and the app can produce something that does not match what you uploaded. Our apps do not identify brands, products or where to buy them, and nothing in them is a representation about any product or retailer.
6. Purchases, credits and subscriptions
Where an app sells digital items, they are bought through the Apple App Store or Google Play, and charged to your store account at confirmation of purchase. We never see your payment details and we offer no payment method outside the official stores.
In Lia, extracting a garment costs one credit per item. Credits are bought in packs, do not expire, and are consumed as you use them. Lia Pro is a monthly auto-renewing subscription that includes 30 credits per period, at the price shown in the app in your local currency as supplied by the store.
A subscription renews automatically at the end of each period unless you cancel at least 24 hours before it ends. Cancel in your Apple or Google account settings — not in the app, because only the store can stop a charge it makes.
Cancelling stops the next renewal. It does not shorten a period you have already paid for.
Digital items are delivered as soon as the store confirms the purchase. If you are a consumer in the EEA or the UK, you have a 14-day right to withdraw from a purchase of digital content, but that right ends once delivery has begun with your express consent and your acknowledgement that you therefore lose it. By buying and using an item you give that consent. The withdrawal right remains for items you have bought and not yet used.
Refunds are handled by the store, under its policy, not by us. Where a refund is granted for credits already spent, the corresponding balance may be reduced, and can go negative until it is settled.
Prices and pack contents can change. A change never affects a period already paid for.
If you delete your account, any unused credits and remaining subscription time are lost, and are not refunded.
7. Free items
New accounts may receive a small number of free credits or items so the app can be tried. They are a courtesy, limited per person and per device, and can be changed or withdrawn at any time. Attempting to obtain more than your share — repeat installs, multiple accounts, automation — may cost you the account.
8. Advertising
Some of our apps are free and supported by advertising. We do not control what any individual advertisement says, and an advertisement appearing in our apps is not an endorsement by us.
9. What you may not do
Do not attempt to access another user's account or data; do not interfere with, overload or reverse-engineer the service; do not use it to process images of people who have not agreed to it, or for anything unlawful.
10. Copyright complaints
If you believe something in our apps or on this site infringes your copyright, write to support@sparkgamestudio.com with enough detail to identify the work and the material. We will investigate and remove infringing material where the complaint is justified.
11. Availability
We aim to keep our apps working, but we do not promise that they will be available uninterrupted or error-free. Features can change or be withdrawn. Some features depend on third-party services and can be unavailable or slow through no fault of ours; where a paid operation fails, the credits reserved for it are returned.
12. Liability
Our apps are for entertainment and convenience. They suggest and they illustrate; they do not advise, and nothing they produce is a statement of fact about any product, brand or retailer.
To the fullest extent the law allows:
We are not liable for indirect or consequential loss, loss of profit, loss of business, or loss of data other than data we hold and lose through our own fault.
Our total liability to you, for everything arising out of or connected with these terms or your use of our apps or this site, is limited to the greater of the amount you paid us in the 12 months before the claim, or US$50.
Nothing in these terms limits or excludes: liability for death or personal injury caused by our negligence; liability for fraud or fraudulent misrepresentation; or any liability that cannot lawfully be limited or excluded. Nothing here affects your rights under the consumer law of the country you live in, and where that law gives you rights we cannot exclude, those rights apply in addition to these terms.
13. Ending it
You may stop using our apps at any time, and delete your account from within any app that has one. We may suspend or close an account that breaks these terms, and will tell you why unless we are prevented from doing so.
14. Changes
We may update these terms. If a change matters, we will tell you in the app before it takes effect, and continuing to use it afterwards means you accept it.
15. Law
These terms are governed by the laws of Israel, and the courts of Tel Aviv have exclusive jurisdiction. If you are a consumer, this does not deprive you of the protection of the mandatory consumer law of the country you live in, or of the right to bring proceedings there.
16. Apple
Where you obtained an app from the App Store: these terms are between you and us, not Apple; Apple is not responsible for the app or its content; Apple has no obligation to provide support or to handle any claim about the app; and Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
17. This website
The content of this website belongs to us or is licensed to us. You may view and print pages for your own use; you may not republish, sell, rent or redistribute them.
You may link to our pages in a way that is fair and does not damage our reputation. You may not frame our pages inside your own site, and you may not imply an endorsement or a relationship that does not exist. We may ask you to remove a link at any time, and you should remove it promptly.
Where the site carries a comment, review or other material you supplied, you are responsible for it, and you confirm it does not infringe anyone's rights.
The site uses cookies to remember your preferences and to measure how it is used. You can refuse them in your browser; parts of the site may then work less well.
